LAW Nr.329/2003 on the profession of private detective, with subsequent modifications and additions
RULES enforcement Nr.329/2003
Parliament of Romania adopts this law.
CHAPTER I
General
Article 1. - (1) Detective particular person is certified under this Act and without prejudice to the right of intimate life, family and private or other rights and fundamental freedoms at the request of natural or legal persons performing specific investigation on :
conduct and public morality of a person;
data on the solvency or severity of a natural person or legal potential partner in a business;
people missing from home;
property subject to civil litigation or criminal nature of ownership in order to prejudice the interests of a part in the process;
ensuring protection against leakage of information from the private life or economic activity they wish to preserve their confidentiality.
(2) private detective work can not be contrary to domestic laws or regulations to which Romania international is a party, national security, public order or morality.
(3) Information obtained in the following activities of private detective are intended solely for its customer, under this law.
Rules:
1.1. By investigating specific, meaning in these Rules, means the activities of study and evaluation of research carried out for investigation by private detective using methods and procedures suitable work in order to achieve pregnancy including investigation, according to appropriate, specific measures that ensure coverage protection investigation.
1.2. Detective refuse particular case when the client request activities that violate the laws in force or morals and will communicate this to the police, and if it finds that the information requested by customer concerns national security, will immediately refer the authorities with responsibilities in the field.
Article 2. - (1) Detective can exercise their particular profession, as appropriate, in the specialized company or individual practices of private detectives, set up under commercial law and operates under license issued by the General Inspectorate of Romanian Police.
(2) The activity of the specialized companies and individual practices of private detectives is unique.
(3) executive leaders companies specialized private detectives must be graduates of the faculty of law or a school or post Detectives have served as police officer or worker in a public institutions with attributions in the field of public order or national security with grade officer and meet conditions stipulated in art. 5 lit.c), d), e) and f).
(4) shareholders associations or societies of individuals specialized private detectives, established pursuant to paragraph. (1), must meet the conditions stipulated by cumulative art. 5 points. d) and e).
Rules:
2.1. To obtain the operating license, associations / societies specialized shareholders must meet the conditions stipulated in art. 5 points. d) and e) of Law no. 329/2003 on the profession of private detective, with modifications and additions thereto, hereinafter referred to as law.
2.2. To obtain license managers running companies specialized cabinets or a private individual submitted to the inspectorate of the county police or General Directorate of Bucharest Police, as appropriate, the following documents:
request addressed to the General Inspectorate of Romanian Police - Directorate for criminal investigations, which require the issuance of operating license, registered and dated, from which the name, address of head office / administrative and points, the name and quality of executive managers, the number phone and fax;
copy of the property or premises used for social / administrative and the work;
executive leaders for the company - a copy of the diploma of university studies for graduates of law schools or a post of private detectives or other certificates of to indicate that they served as a policeman or a worker in the public institutions with attributions in the field public order or national security with the rank of officer;
opinion, a copy issued by the inspectorate of police or county, if necessary, by General Directorate of Bucharest Police, which operates in the range the company or individual cabinet private detectives;
written and signed statement of that result as not carrying on an activity involving the exercise of public authority for the executive leaders;
copy of the instrument of incorporation, which will be specified NACE code, or the contract status of society and society, as appropriate, or status cabinet a private individual;
copies of the identification cards of the executive managers;
copy of the certificate of registration of company office to register the trade;
medical certificates, the original leaders of the executive;
list of the material-technical, transportation, communications, the audio-video equipment identification, surveillance centers and technical computing, which will use them;
copy of the certificate of a private - only for individual offices;
rules of organization and functioning;
certificate of criminal record.
2.3. Medical scales for achieving the quality of private detective shall be established by order of the Minister of Administration and Interior, the Ministry of Health.
2.4. Rules of organization and operation will have the following contents:
general provisions;
Organizational structure of the company;
conditions of employment (in compliance with labor laws and provisions of Law nr. 329/2003);
staff training in control and activity;
responsibilities of company personnel office or individual;
equipping staff;
flow of information resulted from the investigation process and the access level of the personnel company / individual cabinet to them;
final provisions, which will include mandatory provisions in relation to the obligation not to engage in personnel actions of force in enforcement, debt recovery, street conflicts between groups or individuals, the obligation of cessation of employment with the employee in case of withdrawal of the opinion or certificate to pursue the profession of private detective, and the obligation to notify, within 10 days, county police inspectorate or the Directorate General of Police of Bucharest, as appropriate, regarding changes made in organizational structure, address registered office or work points.
2.5. County police inspectorates and the General Directorate of Bucharest Police will forward, within 5 days of receipt, the documents mentioned in section 2.2 to the General Inspectorate of Romanian Police - criminal investigations directorate, reasoned proposals on the issue of operating license .
2.6. Termination or interruption of the activity for which a license has been granted operating company, with details of time, will be communicated within 10 days in county police inspectorates or the General Directorate of Bucharest Police, as appropriate.
2.7. All documents specified in section 2.2 will be submitted in two copies in the copy, except the certificate of criminal record provided in section 2.2 letter. m) and medical certificates provided for in section 2.2 letter. i), which will be submitted in original and accompanied by a copy.
2.8. Operating license is issued by the General Inspectorate of Romanian Police only after verifying that all conditions stipulated by law.
2.9. Form and content licensing operation are provided in Appendix. 1 to these Rules.
2.10. To achieve the object of unique, specialized companies and individual offices can perform:
specialized consulting;
investigative activities for the provisions of art. Article 1. (1) of the Act, using the means, procedures and methods of work and any other activities permitted by law and under the law in order to solve the case.
Article 3. - (1) Detective particular obligation to preserve professional secrecy of data and information obtained.
(2) data and information provided in para. (1) may be disclosed upon request under the law, but courts and Public Ministry, if they are useful for finding the truth in criminal cases.

CHAPTER II
Obtaining of private
Article 4. - The private investigator can be done only by persons who are professionally certified.
5. - Can achieve as a private person who fulfills the following conditions:
Romanian citizenship is nationality or one of the Member States of the European Union or the European Economic Area;
have at least secondary education and is a graduate of a school or post-Detectives served as a police officer or worker of the public institutions with attributions in the field of defense, public order or national security or is a graduate from institutions of higher education;
is fit from a medical point of view;
not have been convicted for crimes committed intentionally;
not carrying on an activity involving the exercise of public authority;
obtained the opinion of the county police inspectorate or the Directorate General of police of Bucharest, as appropriate;
has passed the examination of quality certification of private, according to Art. 7, or holds a certificate of qualification in the profession or a similar certificate issued in one EU Member States and the European Economic Area.
Rules:
3.1. Citizens of EU Member States or the European Economic Area to acquire private in Romania:
a) recognition by the General Inspectorate of Romanian Police certificate of qualification in the profession or a similar certificate issued in one Member States of the European Union or European Economic Area, according to Law no. 200/2004 on the recognition of diplomas and professional qualifications for regulated professions in Romania or
b) pass the exam certifying the quality of private, according to art. 7 of law.
3.2. Citizens of EU Member States or the European Economic Area may be the proof required by art. 5 points. c) and d) of the Act with the equivalent of those provided in art. 6 point. f) and g) of the Act, issued by the competent authorities of one of them.
3.3. Documents that at to training in the profession or professional experience required under art. 2. (3) and art. 5 points. b) of the Act, issued in one Member States of the European Union or European Economic Area, shall be recognized in a professional by the General Inspectorate of Romanian Police, according to Law no. 200/2004.
3.4. Documents ating education and academics, issued abroad, provided in art. 2. (3) and art. 5 points. b) of the Act, shall be recognized by the Ministry of Education and Research.
3.5. Provisions under section 3.1. a), section 3.3 and 3.4 applies to Romanian citizens.
3.6. Recognition procedure stipulated in section 3.1 letter. a) and section 3.3 is established by order of administration and interior minister.
6. - To support the examination of quality certification of private, interested persons must submit to county police inspectorates or, at the General Police of Bucharest, the following acts:
application;
curriculum vitae;
the act of marital status, copy;
the study, copy;
the graduation of a specialized course in copy;
certified medical and psychological issued by a medical specialist, respectively, by a laboratory;
certificate of criminal record;
statement of that result that is not in the situation referred to in art. 5 points. e);
evidence supporting the charge for the payment of the examination of certification of knowledge, established in accordance with the laws.
7. - (1) Being a private detective is acquired after verification required by law and examination of candidates by a committee established at the county police inspectorate, and the General Police Directorate of Bucharest.
(2) The Commission stipulated in para. (1) meets quarterly, and verification of knowledge is suitable topic approved by the General Inspectorate of Romanian Police.
(3) After the promotion exam, private detective and a certificate is issued on the basis of which may be administered or hire a company licensed or cabinet may establish individual activities investigation.
(4) person can rejected the appeal submitted to the General Inspectorate of Romanian Police within 3 days, it has an obligation to resolve within 30 days from the filing date.
(5) Citizens of European Union Member States and the European Economic Area who as private can perform specific professional activities in Romania, according to this law, solely on the basis of delegation issued by the company that represents, in order to solve the case you need to make their presence in Romania. Citizens of EU Member States and the European Economic Area shall demonstrate the quality of a private act which proves to be valid in this position in the State of origin or provenance.

Rules:
4.1. Commission to review planned art. 7. (1) of the Act is available by writing to the Director General of Police General Directorate of Bucharest and the chief inspector of the county police inspectorate, and is composed of police officers specialized in the field. The Commission has a president, 2 members and a secretary.
4.2. At the examining board may attend the mandated representatives of professional associations of detectives, with a consultative role in the decision certifying individual.
4.3. Theme examination certificate to be established by the General Inspectorate of Romanian Police, the proposed Directorate of criminal investigations, and shall be made public through the media or by posting the premises by the police units to which the commission certification examination in order to, at least 30 days before the date of examination candidates organization.
4.4. The exam for obtaining the certificate of a private consists of a written , eliminatory and support in an interview. Depending on the results, the candidates are declared "admitted" or "rejected".
4.5. List of circumstances results in the certification exams are displayed at the headquarters of the police unit that organizes the examination, in places accessible to the public.
4.6. Within 24 hours of data display the results, candidates rejected at the examination for obtaining the certificate may appeal filed at the headquarters of the county police inspectorate or the General Directorate of Bucharest Police, as appropriate.
4.7. Appeals shall be settled by a special commission, called the disposition of the police unit chief who organized the exam for obtaining the certificate of private and has comprised: a president, 2 members, police officers specialized in the field and a secretary. The office of president of the appeals committee will be made by one of the deputy inspectors of the county police inspectorate and a deputy director of the General Police Directorate of Bucharest and the position of secretary will be made by the chief structure of human resources unit police.
4.8. Form and content of a private certificate is provided in Appendix. 2 to these Rules.
4.9. On arrival in Romania, before the activities in any capacity as a private in the art. 7. (6), citizens of EU Member States and the European Economic Area must have notified in writing, according to the form presented in Appendix. 3 to these Rules, the unit of the hall where the police will initiate the investigation.
8. - (1) quality of private timings:
by written waiver, which is submitted to the inspectorate of police or county, as appropriate, the General Police of Bucharest;
by canceling the certificate in the art. 23 para. (2);
when the person concerned no longer satisfies the conditions stipulated in art. 5 points. a) and c)-e).
Rules:
5.1. Within 3 days from the date of the commission of a criminal of the facts stipulated by art. 23 para. (2) of the Act, the certificate of private may be canceled by issuing police unit, signed by the disposal of its head.
5.2. Within 5 days from the date of cancellation of the certificate, the police who ordered the measure will about this company that operates the private detective, and a person against whom the measure has been ordered.
5.3. Within 3 days of receiving the communication, the person whose certificate has been revoked is required to submit a ticket for a private unit at police headquarters that ordered the cancellation.
5.4. Within 3 days following the one of the cases stipulated in art. Article 8. (1). c) of the Act, the person who is a private investigator is obliged to communicate in writing this police unit which issued the certificate.
5.5. During cessation or suspension of a private quality, the person concerned is obliged to teach a private admission by the police issuing unit.
5.6. If the certificate is revoked as a result of the contravention specified in art. 18. (1). c) related to art. 15 points. a)-c) of the Act, measurement of cancellation will be communicated with and the responsibilities in national security, according to legal skills, together with data and information obtained.

Article 9. - (1) The promotion of certification exam using private detective in order to proof the quality, private admission.

Release mode, form and content of the ticket is determined by order of administration and interior minister, which is published in the Official Gazette of Romania, Part I.
Article 10. - Practice of the profession of private detective is incompatible with:
paid work in other occupations that involve exercising public authority;
activities that influence independent profession or contrary to morality;
the immediate facts of commerce, except in accordance with the object of activity and performance of specific attributions.
CHAPTER III
Rights and obligations of private detective, the specialized companies and individual practices in which it operates
11. - (1) In practice, private detective is entitled to conduct investigations in connection with persons, goods, facts, dates and circumstances which are the subject of this activity, with strict observance of the rights and freedoms of citizens and laws.
(2) In carrying out the investigation, private detective may require individuals or information that public authorities, by law, are not classified and does not affect life in intimate, family and private or other rights and fundamental freedoms of the person concerned.
Rules:
6.1. In practice private detective is entitled to conduct investigations and surveillance by direct observation, photography, audio-video recording and seek in the archives and records of public institutions, which by law are not classified and does not affect the right to life intimate , family or private, or other fundamental rights and liberties of individuals.
6.2. Data and information requested will be provided with efficiency.
12. - Detective particular the following duties:
to demonstrate professional probity and conscientiousness, the purpose being to his cause in finding the truth for which he was engaged;
to use methods and means of investigation that should not affect the rules of law or the rights and freedoms of citizens;
Rules:
7.1. Private detectives and specialist societies or individual cabinets in which they operate are the following prohibited activities:
interception of communications or conversations made by telephone, telegraph, fax, electronic networks or other means of transmitting voice and data remotely, and access to those spaces for the installation of specific equipment;
interception, unlawful removal, destruction, retention or without the opening of a correspondent or other mail addressed to a person;
intercepted communications in the private environment;
surveillance photo of the location of equipment in private spaces.
to maintain, even after the quality of private, professional secrecy with regard to the acts, facts, dates and circumstances on which he became aware during the activity, except where expressly provided by law;

13. - Private detective, in the activities, it is forbidden to conduct investigations of:
personnel work the diplomatic and consular representations and international organizations with similar status;
business people, held temporarily or permanently, any title, interest in public authorities, institutions or other legal persons of public services or public interest;
confidential data on political, religious, philosophical or trade union and expressing those beliefs on sexual orientation, health, social or ethnic origin of a person;
criminal cases under the judicial work;
Specific activities carried out by institutions with attributions in the field of defense, public order and national security.
Article 14. - Companies specialized cabinets and individual private detectives have the following rights:
and to equip itself to use the technical means of investigation and communication allowed by law;
b) to organize courses and other activities of physical training and improve training for staff own rules:
8.1. For means of communication is mandatory to obtain prior authorization for the frequencies used, released by the General Inspectorate for Communications and Information Technology - IGCTI
8.2. Theme for training and professional improvement of its own staff will be presented by the company executive leaders annually until 31 December of the year for the next year, the General Inspectorate of Romanian Police - criminal investigations directorate, for approval.
8.3. Theme will be used in the training only after approval by the General Inspectorate of Romanian Police.
8.4. If the opinion provided in section 8.2 is not delivered within 10 days of receipt, the topic is deemed approved by law.
to join in associations that represent their interests in relations with other associations or institutions of state;
to request official information from public authorities on persons, property or situations required particular detective in the process of investigation which, by law, are not classified and does not affect life in intimate, family and private or other rights and fundamental freedoms of the person concerned .
Article 15. - (1) The organization and the activities of private detectives and specialized companies in individual offices are required:
to undertake research only on the basis of a signed written agreements with clients;
to establish a register numbered and registered to the inspectorate of police or county, as appropriate, the General Police of Bucharest, which will keep track of cases investigated;
to communicate data and information requested by the prosecutor or court, for settlement of criminal cases;
in cases established that the information obtained concerns national security, to immediately notify the authorities with attributions in the field;
to hire and use for activities specific investigations only person who as a private;
in relation to opportunities and based on conventions, get in practice for students of schools private detectives.
(2) specialized companies and individual offices of private detectives has prepared rules of organization and operation, which provides written approval by the executive heads of the company or individual cabinet chief, as appropriate.
Rules:
9.1. Must investigate all cases highlighted in the register provided for in art. 15 points. b) of the Act, with the opportunity to be included in compulsory and mentions the following:
number of the case is in the specialized work in the office or individual;
client code code corresponding folders Annex-clusters in which the particulars of the client and all documents drawn up when performing activities in that case, the code can consist of digits / numbers, name or designation;
Convention subject to written agreements with clients;
finalizing its case;
code number of the client.
9.2. Companies specialized or individual offices must notify in writing as soon authorities with attributions in the field, according to legal authority, when the data or information, regardless of the manner in which they were obtained, national security concerns, they are obliged to provide Authorities asked the media and possibly the data are fixed.
9.3. It is forbidden to copy, multiplication and transcription of these data and information to those who get in their possession - both private detectives, and other companies specializing in cabinets or individual - and their communication, in any form, other individuals or legal.
CHAPTER IV
Sanctions
16. - Failure to attract the provisions of this law, as appropriate, civil, material, disciplinary, or criminal according.
Article 17. - The provisions of art. 2. (1), Article 4 and the declaration of false information provided by the Article. 6 lit.h) constitute crimes and are punishable under the Criminal Code.
Article 18. - It contravention following facts:
conducting investigations in cases other than those stipulated in art. Article 1. (1) or violating the provisions of art. 12 points. b)-d) and art. 13;
violating the provisions of art. 3. (1) and (3) and art. 7. (6);
violating the provisions of art. 2. (2) and (3), art. 3. (2) and art. 15 points. a)-e).
Article 19. - (1) stipulated in Article Contraventions. 18 shall be sanctioned as follows:
facts stipulated in point. a) and c) with fine from 5,000,000 lei to 10,000,000 lei;
referred to in the deed. b) with fine from 2,000,000 lei to 5,000,000 lei.
(2) In the case of contraventions stipulated by art. 18 points. c), the sanction can be applied fine and legal case in which the limits are from 10,000,000 lei to 25,000,000 lei.
20. - (1) Repeating the contraventions provided it was committed to art. 18 points. a) and c) within one year certificate draws suspension for a period of 3 to 6 months.
(2) Suspension of certificate revocation and suspension are available in all cases, the General Inspectorate of Romanian Police, the proposal county police inspectorates or General Directorate of Bucharest Police and notify the person concerned.
Rules:
10.1. In the situation referred to in art. Article 20. (1) of the Act, ordering the suspension of the certificate in writing by the General Inspectorate of Romanian Police - Directorate for criminal investigations, motivated the proposal of the county police inspectorate or the Directorate General of Police of Bucharest is part of the body found in period stipulated in section 5.1.
10.2. Disposal of suspension will be communicated in writing to the person concerned and society in which it operates, the county police inspectorate or the Police General Directorate of Bucharest, within the term stipulated in section 5.2.
21. - Establishment of contraventions and application of sanctions are the officers designated by the General Inspectorate of Romanian Police.
Article 22. - The Government Ordinance no. 2 / 2001 on the legal regime of contraventions, approved with amendments and completions by Law no. 180/2002, with subsequent modifications, except for art. 28 and 29, applies to contraventions stipulated by law.
23. - (1) violation of obligations stipulated in art. 15. (1). a)-e) and trigger the suspension of the certificate or private, as appropriate, the license operating company specialized cabinet or individual private detectives, for a period between one month and 3 months.
(2) The certificate of private or, as appropriate, licensed operating company specialized cabinet or individual private detectives is canceled if, within a period of one year from the date of the expired term of suspension of certificate or license, is committed in one of the new facts which attract the suspension measure.
Article 24. - (1) The measures provided for in art. 23 relating to suspension or cancellation of certificate of a private is to have county police inspectorate which has issued or, if necessary, by General of Police of Bucharest.
(2) Suspension or cancellation of license to operate company specialized cabinet or individual private detectives are available under this Act, the General Inspectorate of Romanian Police.
Rules:
11.1. Suspension or cancellation of certificate of private ordering by the inspectorate of police or county General Directorate of Bucharest Police in terms stipulated by law and these rules.
11.2. Suspension or cancellation of license to operate a company has a county police inspectorate or the Police General Directorate of Bucharest, only after obtaining approval from the General Inspectorate of Romanian Police - Directorate for criminal investigations.
CHAPTER V
Final
Article 25. - The specific activities performed by specialized companies and individual offices of private detectives is performed by officers designated by the General Inspectorate of Romanian Police, the Ministry of Public.
Rules:
12.1. Monitoring will be conducted annually or whenever there is the result of observation that the activity of the company or individual cabinet of private detectives is not conducted in accordance with legal provisions.
12.2. When the control will be considered in the following aspects:
authenticity of documents establishing and running a company specialized cabinet or individual private detectives and the legality of their operation;
if associations / stakeholders, and the head office of company or individual private detectives and their staff meet the conditions and criteria stipulated by law and these rules;
register stipulated by existing law and recording data required in it;
the existence of incompatibilities or interdictions in the profession of private detective.
12.3. In all cases, findings during the inspection companies specialized offices or individual private detectives will be highlighted in the register of sole control, where mention of the identity and quality control measures proposed and applied sanctions.
Article 26. - General Inspectorate of Romanian Police detectives keep all certified, a company specialized cabinets and individual private detectives.
27. - Classification of activities in the national economy are completed with private business.
Article 27.1. - (1) The provisions of this Act is completed with the legal provisions on recognition of diplomas and professional qualifications for regulated professions in Romania.
(2) documents necessary for obtaining quality private, other than those stipulated in para. (1), free citizens of EU Member States or belonging to the European Economic Area, by the State of origin or provenance, are recognized under the law.
Article 28. - (1) This Law shall come into force 90 days after its publication in the Official Gazette of Romania, Part I.
(2) 60 days after publication, the General Inspectorate of Romanian Police and the Romanian Information Service will develop draft rules implementing the law, which will be approved Government.
This law was passed by the Senate and the Chamber of Deputies in the meeting of 26 June 2003, in compliance with the provisions of Article 74 (1) of the Romanian Constitution.

Law no. 353 of 15 July 2004 amending and supplementing Law no. 329/2003 on the profession of private detective, published in the Official Gazette, Part I no. 670 of 26 July 2004;
Parliament of Romania adopts this law.
Article I. - Law no. 329/2003 on the profession of private detective, published in the Official Gazette of Romania, Part I, no. 530 of 23 July 2003, is modified and supplemented as follows:
In Article 2, after paragraph (3) insert (4) with the following wording: "(4) shareholders associations or societies of individuals specialized private detectives, established pursuant to paragraph. (1), must meet the conditions stipulated by the cumulative art. 5 points. d) and e). "
Article 3 (2) shall read as follows: "(2) data and information provided in para. (1) may be disclosed upon request under the law, but courts and Public Ministry, if they are useful for truth in criminal cases. "
In Article 5, letters a), d) and g) will have the following wording: "a) has Romanian citizenship or citizenship of any Member States of the European Union or the European Economic Area;
d) not have been convicted of crimes committed intentionally;
g) has passed the certification examination of the quality of private, according to Art. 7, or holds a certificate of qualification in the profession or a similar certificate issued in one EU Member States and the European Economic Area. "
In Article 7, after paragraph (4) are inserted (5) and (6) with the following wording: "(5) Citizens of European Union Member States and the European Economic Area who as a private business can specify this profession in Romania, according to this law, solely on the basis of delegation issued by the company that represents, in order to solve the case you need to make their presence in Romania. Citizens of the EU Member States and the European Economic Area are proof quality by a private act which proves to be valid in this position in the State of origin or provenance.

Article 9 will have the following wording: "Article 9. - (1) The promotion of certification exam Detective particular uses, with the aim of proving that quality, private admission.
(2) private admission is nominal and is not transferable. Release mode, form and content of the ticket is determined by order of administration and interior minister, which is published in the Official Gazette of Romania, Part I. "
In Article 15, point c) will have the following wording: "c) to communicate data and information requested by the prosecutor or court, for settlement of criminal cases;
Article 15, insert (2) with the following wording: "(2) specialized companies and individual offices of private detectives has prepared rules of organization and operation, which provides written approval by the executive heads of the company or individual cabinet chief, by case. "
Article 18 shall read as follows: "Article 18. - It contravention following facts:
conducting investigations in cases other than those stipulated in art. Article 1. (1) or violating the provisions of art. 12 points. b)-d) and art. 13;
violating the provisions of art. 3. (1) and (3) and art. 7. (6);
violating the provisions of art. 2. (2) and (3), art. 3. (2) and art. 15 points. a)-e). "
Article 23 shall read as follows: "Article 23. - (1) violation of obligations stipulated in art. 15. (1). A)-e) and trigger the suspension of the certificate or private, if necessary, a license operating company specialized cabinet or individual private detectives, for a period between one month and 3 months.
(2) The certificate of private or, as appropriate, licensed operating company specialized cabinet or individual private detectives is canceled if, within a period of one year from the date of the expired term of suspension of certificate or license, is committed in one of the new facts which attract the suspension measure. "
Article 24 shall read as follows: "Article 24. - (1) The measures provided for in art. 23 relating to suspension or cancellation of certificate of a private is to have county police inspectorate which has issued or, if necessary, by General of Police of Bucharest.
(2) Suspension or cancellation of license to operate company specialized cabinet or individual private detectives are available under this Act, the General Inspectorate of Romanian Police. "
After Article 27 insert Article 271, with the following wording: "Article 271. - (1) The provisions of this Act is completed with the legal provisions on recognition of diplomas and professional qualifications for regulated professions in Romania.
(2) documents necessary for obtaining quality private, other than those stipulated in para. (1), free citizens of EU Member States or belonging to the European Economic Area, by the State of origin or provenance, are recognized under the law. "
Article II. - Law no. 329/2003 on the profession of private detective, with modifications and additions made by this law, will be republished, giving the texts a new numbering.
This law was passed by the Parliament of Romania, in compliance with the provisions of art. 75 and art. 76 para. (1) of the Romanian Constitution, republished.
